The http://www.smallanimalultrasonography.com website is a video learning platform for veterinarians and students (‘Small Animal Ultrasonography‘ or ‘the platform’). Small Animal Ultrasonography offers training in the form of videos on animal ultrasounds.
Small Animal Ultrasonography is an initiative of Dr. Marc-André d’Anjou and Dr. Dominique Penninck, headquartered at 650 des Pinsons Street, Longueuil (QC) CANADA, J4G 2L2.
By using our platform, you acknowledge that you have read these terms and conditions of use (‘General Terms’) as well as our Privacy Policy and Cookie Policy, and expressly accept the rights and obligations associated with them.

1. DEFINITIONS
The terms used in the Terms and Conditions must be understood as follows:
– “Visitor“: anyone who simply consults Small Animal Ultrasonography without creating an account. The Visitor has limited access to the videos and information available on Small Animal Ultrasonography in the form of excerpts or trailers.
– “Subscriber“: any Visitor who creates a free account on Small Animal Ultrasonography. Creating an account is necessary to purchase paid videos.
– “Member“: any Subscriber who wishes to join Small Animal Ultrasonography on the basis of an annual subscription. The Member enjoys various benefits such as an extension of the access period for purchased videos and exclusive promotional offers that will be offered to him occasionally.
– “User” (also referred to as “you” and “your”): all Internet users who use Small Animal Ultrasonography, i.e. Visitors, Subscribers and Members depending on the context.
2 ACCEPTANCE OF TERMS AND CONDITIONS
By visiting and using Small Animal Ultrasonography, the User acknowledges that he has read our Terms and Conditions, understand them and accept them expressly. However, these changes have no retroactive effect. By continuing to use Small Animal Ultrasonography, the User is assumed to have accepted the Terms and Conditions as amended. The User is therefore required to read this document on a regular basis.

3 INSCRIPTIONS FOR SMALL ANIMAL ULTRASONOGRAPHY
3.1 CONDITIONS
Users can sign up for Small Animal Ultrasonography by creating a user account. In doing so, they can watch our free videos and/or buy access to our paid videos. Creating an account is free and is done using a form to complete online. You must provide a certain amount of information necessary to provide the services of Small Animal Ultrasonography. Information marked with an asterisk is required to create the account.
The User is required to provide accurate, complete and up-to-date information. In the event of a change in circumstances, the User is required to update his personal information. Small Animal Ultrasonography has the right to demand proof at any time regarding the authenticity of the data and the identity of the Subscriber by asking him to send him a written certificate.
Your personal data is collected and processed by Small Animal Ultrasonography exclusively for the purposes mentioned in our Privacy Policy.

Each User is entitled to only one user account. Registration of multiple accounts under various names is strictly prohibited.
3.3 BECOME A MEMBER
In addition to free registration, you have the opportunity to become a Member of Small Animal Ultrasonography. This is a subscription system with an initial duration of two years.
The Member enjoys various benefits such as an extension of the access time to purchased videos and access to exclusive promotional offers. The website shows which videos are included in the subscription.
To become a Member, the User must log into their user account. Once logged in, the user can click “become a member” above the page. On this page, the User is required to complete the required fields and choose the type of subscription desired. The price of the subscription is payable immediately at the time of the affiliation. The payment is worth confirmation in the head of the User.
The User can choose between different subscription formulas. The website specifies the specifications of each subscription. We recommend that you carefully read the specifications of each subscription.
The User will receive a confirmation email from Small Animal Ultrasonography at the email address listed.
4 USE OF THE PLATFORM
The User will use Small Animal Ultrasonography in accordance with these General Conditions but also with current legislation, the rights of third parties and the general principles applicable on the internet. Any other employment is strictly prohibited and will automatically terminate the User’s right to use. These include:
It is forbidden to access Small Animal Ultrasonography by the illegal use of accounts of other Users.
It is forbidden to register on Small Animal Ultrasonography and/or to register for training under a false identity and/or with third-party data.
It is forbidden to interfere with the proper functioning and security of the platform, including by spreading malware or computer viruses.
It is forbidden to interfere with the experience of using other Users or to cause them any damage.
The User prohibits any excessive use of Small Animal Ultrasonography. “Excessive use” refers to any use of the platform that would be significantly more intense than the use made by an average user. In case of excessive use, Small Animal Ultrasonography will inform the User and force him to take measures to limit its excessive use. If the excessive use of the platform continues, Small Animal Ultrasonography reserves the right to take the necessary measures to limit this use and guarantee qualitative use to other Users, including by suspending or deleting the User’s account.
In case of non-compliance with the above rules, Small Animal Ultrasonography will have the option to suspend or delete the account of the user concerned without prior warning. Small Animal Ultrasonography is not required to pay any refund or compensation.
The User may, at any time, and for whatever reason, decide to terminate his right to use by ceasing to use Small Animal Ultrasonography. If the user wants to permanently delete their user account, they must send an email request to smallanimalultrasonography@gmail.com
Small Animal Ultrasonography agrees to respond to it no later than one (1) month after receiving the application. In the event of the account being deleted, Small Animal Ultrasonography nevertheless retains certain information necessary for the platform to function properly and to comply with its legal obligations. Removing the account results in the deactivation and inaccessibility of the user account as well as all other services offered on Small Animal Ultrasonography.

5.3 USER CONTRIBUTION AT SMALL ANIMAL ULTRASONOGRAPHY
Small Animal Ultrasonography can give the User the opportunity to contribute to Small Animal Ultrasonography by adding personal content to the platform, such as reviews or reactions to available videos. The user guarantees the quality of the content he publishes on the platform. It acknowledges and confirms that it is fully responsible.
The User accepts the display of his content on the platform as well as his identity (name and surname). Small Animal Ultrasonography reserves the right to use user feedback for marketing, promotional and advertising purposes on all the means of communication it uses (website, social networks, newsletters, special offers, applications, etc.) and to pass them on to its business partners.
Small Animal Ultrasonography is not required by a general obligation to monitor content published by Users. Nevertheless, it reserves the right to refuse or remove, in whole or in part, content at its sole discretion.
6 PRICES AND PAYMENT TERMS
6.1 PRICE
All prices listed on our website are expressed in $US and do not include applicable taxes. Other additional costs (such as the costs associated with using certain payment methods) are also not included in the original price. However, the overall price will always be expressly stated at the last stage of our online shopping process.
Small Animal Ultrasonography reserves the right to change its prices at any time but undertakes to apply the rates shown on the platform at the time of purchase.
6.2 PAYMENT TERMS
All payments are processed in full and immediately at the time of purchase. We accept all valid credit cards commonly used internationally as well as electronic payment methods, as shown on our platform.
Small Animal Ultrasonography takes all reasonable steps to ensure the safety of your online transactions.
The Member of Small Animal Ultrasonography pays by direct debit online.
The payment is worth confirming the purchase. The User will therefore be bound to a payment obligation. From the moment the payment is made, the video is available to the User for consultation for one year.
Your invoices can be viewed online in the “Orders” section of your user account.
As soon as the agreed period expires, Small Animal Ultrasonography will automatically remove access to videos, features and other subscribed subscriptions. Small Animal Ultrasonography does not provide any refund for the User if the user has not sufficiently exploited his right to use or if access to the platform is fully or partially, temporarily or constantly, limited or prevented.
Any claim regarding the (processing of) payment must be addressed in writing to Small Animal Ultrasonography within 15 days of purchase. Small Animal Ultrasonography is not required to repay.
7 DURATION AND TERMINATION OF SERVICES
If the User violates our Terms of Use, current legislation, third party rights or any other general principle applicable on the internet, Small Animal Ultrasonography will have the option to suspend or terminate its right of use, including by suspending or deleting its user account. Small Animal Ultrasonography can act without prior warning. If the User feels that these measures are unjustified, he is obliged to inform Small Animal Ultrasonography within 15 days. Small Animal Ultrasonography is under no obligation to cancel the action taken. The User is not entitled to any refund or compensation of any kind.
The User may at any time and for any reason decide to terminate his right to use by ceasing to use Small Animal Ultrasonography. If the user wants to permanently delete their user account, they must make an explicit request by email to smallanimalultrasonography@gmail.com. Small Animal Ultrasonography agrees to respond to it no later than one (1) month after receiving the application. Small Animal Ultrasonography nevertheless retains certain information necessary to ensure that the platform functions properly or that its legal obligations are met. Removing the user account results in the deactivation and inaccessibility of the user account as well as all other services and complementary features of Small Animal Ultrasonography.
As soon as the deadline expires, the user will no longer have access to the content of Small Animal Ultrasonography.

8 INTELLECTUAL PROPERTY
Small Animal Ultrasonography and its contents are creations protected by intellectual property, in particular copyright, computer program law, database law, design law, trademark law and other applicable intellectual rights. “Content” refers to texts, images, logos, photos, videos and other similar material, as well as the selection and presentation of this content on the platform.
By visiting and using Small Animal Ultrasonography, the User will be granted a limited right to access, use and display the platform and its content. This right is granted on a non-exclusive, non-transferable basis and can only be used for personal and non-commercial use. The above clause also refers to content whose intellectual property rights are the rights of Users and third parties. Users and third parties retain their intellectual property rights over their own content, even after it is published on the platform.
By publishing content on the platform (by upload), the User grants Small Animal Ultrasonography a non-exclusive, free, communicable and global license to use, reproduce, transform and communicate content to the public to third parties, provided it is necessary to offer the services of our platform. This license is not time-limited and covers all of the above intellectual property rights. The license is necessary to ensure that our platform works properly. Its use is limited to this objective.
9 PROCESSING PERSONAL DATA
The personal data provided by the User during his visit and/or use of Small Animal Ultrasonography is necessary to ensure the proper functioning of the platform and the provision of the services of Small Animal Ultrasonography. Your personal data is collected and processed by Small Animal Ultrasonography exclusively for internal purposes. 10 RESPONSIBILITY
Small Animal Ultrasonography can only be held liable for any serious or slight and repeated faults (contractual or extra-contractual) attributable to it and committed in connection with the execution of these Terms and Conditions. Nor do we exclude liability for intentional misconduct or fraud. Small Animal Ultrasonography‘s liability is limited to the direct damages resulting from such breaches and can never be greater than the value of the last purchase. Small Animal Ultrasonography cannot be held responsible for any form of indirect damage that would result from such breaches. “Indirect damage” means that any form of indirect harm, missed profit, loss of earnings, financial or commercial loss, loss of customers, increased costs, etc. should be understood.
If the User is liable to Small Animal Ultrasonography for a contractual or extra-contractual breach, the User will have to take all necessary measures to protect Small Animal Ultrasonography from any claims or damages it may suffer on that occasion.
Small Animal Ultrasonography cannot be faulted if the breach is attributable to the fault of the User, a third party who is foreign to the provision of the service or to a case of force majeure.
